The Different Types of Misdemeanor Charges

A misdemeanor is an offense that is lesser in severity than that of a felony, but more serious than a summary offense. Misdemeanors may be segmented according to severity or according to the nature of the misdemeanor committed. Below is an overview of the different classes of misdemeanor charges:

Crimes against property
  • Simple Trespassing:  Entering another person's private property without permission.
  • Vandalism:  This involves an intentional act that destroys or damages another person's property. 
  • Theft:  This is defined as taking property belonging to another person without permission. It is a misdemeanor when the value of the item is below a certain amount and no form of violence involved.

Crimes against a person 
  • Harassment: This pertains to continuing unwelcome actions toward another person, stalking, or activities that cause an individual to fear for his or her safety.
  • Simple assault: A misdemeanor assault is a physical attack that does not result in any serious injuries. 
 Crimes against public safety
  • Recklessly endagering another person: A misdemeanor endangering offense occurs when someone places another at risk of serious bodily injury or death.
  • Driving under the influence (DUI):  A DUI offense is a misdemeanor, provided it does not cause serious consequences.
A misdemeanor is punishable by a fine, prison sentence up to five years, probation, court supervision, and/or community service.
